Verdict Upheld

Former police chief Bob Mikles, a Kevin Hickey client, sued the City of Huntington for wrongful termination and breach of contract in the Summer of 2005.  Mr. Mikles was awarded over $30,000 in damages and attorney’s fees.  The City of Huntington appealed, but the Court of Appeals upheld the wrongful termination verdict.  Below is a link to the newspaper article in The Times Record.

What About Child Support?

Child support is one of the most common post-divorce issues.  Because child support directly affects the financial situation of children, it can be one of the more frustrating, and stressful, post-divorce problems.  Here are some things to keep in mind about child support:

• Child support is determined by using the net income (take home pay) of the non-custodial parent.

• Child support is to be used for the child(ren).  This includes clothes, food, shelter, and school supplies.

• Child support may be modified if the non-custodial parent’s income increases or decreases.  This is not automatic.  A motion will need to be filed with the court.

• Child support may be deducted from the non-custodial parent’s paycheck by his/her employer.

• Is the non-custodial parent not paying his/her child support?  There are ways to remedy this.  Seek competent legal advice.

Jail is Still Alive and Well as a Punishment for Contempt of Court

Remedies for contempt of court in divorce cases range anywhere from a warning to spending time in jail.  Jail is usually seen as an extreme remedy, and is in fact rarely needed.  However, this CNN article shows that jail is alive and well as a remedy for contempt as this husband has discovered.
